How the Mediation Process Works

Under Florida’s Mediation Confidentiality and Privilege Act (section 44.405, Florida Statutes), statements made during mediation generally can’t be used as evidence in court. If mediation produces a signed agreement, that agreement becomes a binding contract that can be submitted to and enforced by the court. It isn’t shielded by those confidentiality protections. If mediation doesn’t produce a full resolution, the case moves toward trial, and neither party waives the right to litigate by participating.
